Privacy Policies

DIRECTV exerts all of its efforts to protect its users’ privacy. This Policy explains how DIRECTV collects, uses, and shares information about you when you subscribe to our services and visit our Web sites. Your use or receipt of DIRECTV® products or services (including our Web sites or online applications) constitutes an express acceptance of this Policy and authorizes DIRECTV to collect, use, and share information in the terms described in the same.

Types of information we collect and how we collect it

In discussing the types of information we collect about our subscribers, users of our online applications and services, and visitors to our Web sites, it is important to distinguish between two categories of information. We use the phrase "Customer Information" as a broad general term that refers to any information relating to you or your DIRECTV service, including Account Information, Service Information, Anonymous Viewing Information, Diagnostic Information, Commerce Information, and Web Site Information. These terms are defined in more detail in Section A below. We use the term "Personally Identifiable Viewing Information" to refer to information about your personal viewing habits that we collect only with your express consent. This term is defined in more detail in Section B below.

A. The following are specific types of Customer Information that we collect or might collect from subscribers, users of our online applications and services, and visitors to our Web Site:

"Account Information" means information about the account of your service with DIRECTV, including but not limited to your name, address, social security number, electronic mail address, telephone number, programming package selected and programming purchases and downloads made,consumer credit reports, models and serial numbers of your DIRECTV receiver or another device authorized to access DIRECTV programming or services (an “Authorized Device”) and privacy preferences. The Account Information excludes any type of Personally Identifiable Viewing Information or Anonymous Viewing Information as defined below. We receive your Account Information directly from you when you activate or change your service, as well as from third parties such as consumer reporting agencies and consumer data reporting agencies. We can combine the information obtained from third parties with the Account Information collected by us.

"Service Information" means information necessary for us to provide the service to your DIRECTV receiver or for allowing your Authorized Device to have access to the DIRECTV programming or services. Examples of this type of information include the physical configuration of your Authorized Device, the number of the version of the program corresponding to your DIRECTV receiver, and the success status of the last attempted service calls made by your DIRECTV receiver.

"Anonymous Viewing Information (AVI)" means information about the use of your DIRECTV receiver, DIRECTV online application or Authorized Device that is not related or bound to your Account Information. For instance, your DIRECTV receiver periodically sends us Anonymous Viewing Information about the equipment which is not associated with you or with any subscriber, thus we protect your personal identity and privacy. This information allows us to know, for instance, that a subscriber in a particular city watched a program or event, but it does not allow us to associate such preferences specifically with you. Also, if you use a DIRECTV online application in an Authorized Device with enabled features based on the location, we collect and use precise data about the location delivered by the Authorized Device in order to personalize specific programming options and services available through the online application. These data about the location do not identify you personally, but they deliver the geographical location of your Authorized Device on a real time basis. You may request at any time that we cease collecting Anonymous Viewing Information from your DIRECTV receiver as described in Section IV below. Note that DIRECTV does not control the physical equipment and the programs of the different Authorized Devices that you may use to access DIRECTV programming or services, then, it might occur that ceasing the collection of Anonymous Viewing Information in all Authorized Devices is not technically possible.

"Diagnostic Information" means detailed information about the operation of a DIRECTV receiver, a DIRECTV online application, or an Authorized Device. We collect Diagnostic Information logs from a few randomly sampled DIRECTV receivers for quality control and troubleshooting purposes. These logs identify your DIRECTV receiver and are, therefore,associated with the account of your service with DIRECTV.

"Commerce Information" means Personally IdentifiableInformation that enables a DIRECTV commercial partner to fulfill your request for participating in a promotion or transaction of for any other commercial purpose related to the services that DIRECTV provides. From time to time, we may present on-screen offers or activate the purchase of goods and services from us or third parties. Only if you take advantage of such offer or engage in a transaction, will we collect and send on your behalf information such as your name and address or your interest in a specific offer or transaction to the sponsor of the promotion or transaction. In addition to fulfilling your request, such commercial partner may also use your Commerce information to send you otherinformation in which you might be interested, consistently with its own privacy policies.

"Web Site Information" means information collected and stored by our Web servers when you become a registered user of, or visit, our Web sites or when you use an Authorized Device (such as a mobile phone) to register with, access or enter your account of service with DIRECTV. We may collect information that you provide us in this way (including your e-mail address) and use it in accordance with this Privacy Policy. Even if you are not a DIRECTV subscriber, we may collect information about visitors to our Web sites and about the users of our online applications and services as follows:

Cookies and other Technologies Our Web Sites, online applications and services, and electronic mail messages may use cookies, e-tokens, and other technologies. These technologies help us better understand the users’ behavior, indicate us the parts of our Web Sites that are visited by persons and which featuresof our online applications and services are used; they also control access to specific DIRECTV programming and services by identifying the personal preferences and the configuration of the Authorized Devices. We also use these technologies to deliver notices about our online applications and services bearing a relation to your interests and to measure the effectiveness of advertising campaigns. These technologies remain on your computer or another Authorized Device and are automatically retrieved when you visit our Web site at a later time or access a DIRECTV application service using the same Authorized Device. These technologies contain only information concerning the type of customer (subscriber or visitor), DIRECTV programming and authorized services and frequently visited pages. No other type of Customer information is stored on these technologies. If you are uncomfortable with these technologies, you may disable them on your Authorized Device. Disabling cookiesmay affect Web site functionality, but the design of our Web sites allows access to most offerings even with cookies disabled. Visitors who have disabled cookies, however, will not be able to use DIRECTV’s personalized account management functions. In addition to disabling cookies or other technologies, an Authorized Device may restrict DIRECTV services that are accessible from, delivered by, exhibited at, or accessible by links through such Authorized Device.

Electronic Newsletters If you subscribe to DIRECTV’s electronic newsletters, we will keep your e-mail address on file.

Aggregate information about Web site visitors. We create aggregate reports about visitors to our Web Sites in order to measure the performance of our sites. These reports do not contain Customer Information.

Aggregate information about online applications and services. We create aggregate reports about users of our online applications and services with the purpose of measuring performance and controlling quality and for troubleshooting purposes. These reports provide for Diagnostic Information. When you enter your DIRECTV account during the use of one of our online applications, the Diagnostic Information is associated with the account of your service with DIRECTV and, therefore, certain reports may also contain other Customer information.

Links to other Web sites. When you visit our Web sites or use our online applications or services, you will find many opportunities to access Web sites of third parties. When you click onthe links to such sites, DIRECTV's Privacy Policy no longer applies. We recommend that you read the privacy policy of the Web sites of third parties.

B. "Personally Identifiable Viewing Information" means information about the use of your DIRECTV receiver or online applications or services specific to DIRECTVif that information is linked to or associated with your Account Information. We do not collect Personally Identifiable Viewing Information unless you give us your express consent to do so. You may choose to consent to DIRECTV's collection of your Personally Identifiable Viewing Information by changing your privacy preferences as provided in Section IV below.

Use of CustomerInformation

We use Customer Information to deliver our service to customers and to better understand what our customers want, so that we can continue to provide a compelling entertainment service at a good value. Specifically, we use Customer Information for feedback, editorial, marketing, and promotional purposes, for statistical analysis, for new product development and content improvement, for verification of prospective customer qualifications, for billing our service, and for other related business purposes. We can use Customer Information to deliver advertising of goods and services that may be of your interest within our video service and online applications and services. We do not use Personally Identifiable Viewing Information to publish said notices.

Your express consent to our collecting your Personally Identifiable Viewing Information may help us provide you with a more personalized compelling entertainment service. It may help us recommend viewing choices and personalize your viewing experience. Also, we may use this information for surveys, audience measurement, and other legitimate business purposes. If you have the DIRECTV DVR service, your DIRECTV® DVR may use your viewing information to recommend programs for you.

As noted above, we do not collect your Personally Identifiable Viewing Information without your consent. Your consent being absent, no “tag” is added to the anonymous viewing file transmitted from a DIRECTV receiver to us that would enable us to identify the DIRECTV receiver from which it came.The only implication of the absence of your consent to our collecting your Personally Viewing Information with respect to the DIRECTV online applications and services will be that you may not be able to have accessto certain programming, features, and functions (such as the DVR Programmer) that require certain personal information in order to operate.

All information collected by DIRECTV, including your Personally Identifiable Viewing Information, may be transferred, hosted and processed in countries other than your country of origin according to the commercial needs of DIRECTV and the legislation in force.

When we share Customer Information with third parties

We share Customer Information with third parties when necessary in order to conduct a legitimate business activity related to serving our customers, including the following:

Support Services: We share Customer Information with providers of bill processing, technical assistance, collection and other support services. We take reasonable steps to require these third parties to maintain the confidentiality of the Customer Information and require them to adhere to this Privacy Policy.

Third Party Services: We share Customer information with third parties in order to coordinate delivery or billing of the services provided by such third parties to your DIRECTV receiver and Authorized Devices and to deliver notices in our video and online applications and services. We take reasonable steps to require these third parties to maintain the confidentiality of the Customer Information and require them to adhere to this Privacy Policy.

Subsidiaries and other companies commercially related to DIRECTV. We may share Customer Information with subsidiaries and other companies commercially related to DIRECTV. If we choose to share data in this fashion, we will require these companies to observe this Policy.

Marketing. We may share Customer Information, including programming purchases, with selected media, entertainment and other similar service providers, in addition to third parties with which we offer joint or co-branded products or services. These third parties may use this Customer Information to market products or services to you.

The aggregate information and the Anonymous Viewing Information is information that does not identify you and we may reveal such information and any resulting analysis to third parties, including suppliers, advertisers, broadcasters, research companies and other organizations, with no limitation whatsoever.

When you elect to participate in a special offer or engage in a transaction with DIRECTV or a third party advertiser or promoter through your DIRECTV receiver or DIRECTV online application or service, we will collect and disclose your Commerce Information, on your behalf, to the party sponsoring or delivering the promotion. This information is disclosed only upon your affirmative response to an offer. In addition to fulfilling your request, that party may also use your Commerce Information to send you additional antecedents in which you might be interested, consistently with its own Privacy Policies.

Legal Requirements We may share Customer Information or Personally Identifiable Viewing Information with third parties in order to meet legal requirements, to answer legal processes or, where permitted by law, to protect our rights and property, including in order to fight identity theft or conduct investigations into fraudulent billing. In most cases where disclosure is made under a legal process and where permitted by law, we will provide you with prior notice of such subpoena or judicial order so that you may contest the same in a court proceeding.

Sale or transfer of the business. We may share Customer Information with third parties in connection with the sale, transfer, or another assignment of our business. If we are acquired by another company, that company will possess the Customer Information collected by us and will assume the rights and obligations regarding your Customer Information as described in this Privacy Policy.

Your choices regarding our collection and use of Customer Information

The default privacy preferences, to which you hereby consent if you do not change them, do not allow us to collect Personally Identifiable Viewing Information, but do allow us to collect, use, and disclose all Customer Information in manners consistent with this Privacy Policy. You may choose to change your privacy preferences to allow us to collect your Personally Identifiable Viewing Information.Even though Anonymous Viewing Information does not include any Account Information whatsoever, you may request that we disable the option of collection of such information from your DIRECTV receiver.

You may choose not to receive noticesin our video and online services and applications selected for you based on your Account Information. However, depending upon the online application or service, you may continue to receive notices in connection with the content of a Web site or in a DIRECTV service or application or on the basis of other non-personal information. Your request for elimination of notices applies exclusively to DIRECTV advertising services and does not affect advertising based on interests of other advertising networks that may have access to your information through other services or applications available in an Authorized Device.

You may choose not to receive communications that we send to you based on your Account Information.If you make this choice, you understand that we will not be able to inform you about any upcoming features, improvements, or promotions regarding your DIRECTV service. However, we will collect and use your Account Information (including Service Information) and Diagnostic Information for legitimate business purposes.

How long we keep Customer Information

We keep your Customer Information for as long as we provide services to you, and beyond that for related business activities, unless you expressly request deletion of the same. Once the information is no longer necessary for our commercial activities, we destroy the information unless there is a current request or order for preserving the information.

Our contact policy

We may, from time to time, contact you by regular mail, e-mail, or telephone to tell you about additional products or services that we offer or third parties may offer. If you do not wish to be contacted or receive promotional materials, contactyour DIRECTV local provider by any means (consult the corresponding DIRECTV’s local provideror Privacy Policy for details).

How we protect the security of Customer Information

We take reasonable steps under the current legislation to protect your Customer Information by using security technologies and procedures that limit access to our databases. However, no system is completely secure or error-free. We do not and cannot guarantee the complete security of your Customer Information.

On-line credit card transactions

We protect the security of credit card transactions on the Internet by using a secure, encrypted Web server. We maintain credit card information collected during transactions in a secure database at DIRECTV for fraud prevention and for our accounting and billing. Your credit card information is not released to unauthorized parties while in these databases. Stored information about credit card transactions is not released to any third party except in response to a subpoena or court order.

Your access to information

You may access the information we collect about you and correct any error in said information by contacting us at any time via electronic mail.

Changes to this Privacy Policy

We reserve to ourselves the right to change this Privacy Policy at any time. If we make a significant change with regard to our collection or use of information about our customers, we will exhibit a note on the main page of our Web site to the effect that this Policy has been updated and we may take additional reasonable steps to notify you about the new or revised Policy. In most cases, we will attempt to notify you in some form at least 30 days before the effective date of the change.
